MHRA discuss dispensing error legislation

Following a meeting with the four UK Health Departments and associated pharmacy bodies, the MHRA have confirmed they will be preparing to introduce an amendment to the current Health and Social Care Bill that aims at protecting pharmacists from automatic criminalisation for dispensing errors.

The proposed amendment will ensure that anyone at risk of prosecution from dispensing errors will be able to defend their case, through being able to demonstrate that they had exercised all due diligence in preventing such an offence from occurring.

The announcement also included the proposed introduction of a due diligence defence relating to labelling and leaflets. As yet, there has been no confirmation of timescales, however the MHRA indicated that this would be a first in a series of actions over the coming months.
